Fighting rider bias

Many people assume the biker was speeding. Your case has to prove them wrong.

Where bias shows up

  • Lower settlement offers based on “assumed risk”
  • Arguments that you were speeding without real evidence
  • Blaming your gear, your bike or your appearance
  • Jurors who have never ridden

How we answer it

  1. Physical evidence. Crush damage, skid marks and final positions can show speed better than opinions can.
  2. Experts. Accident reconstruction, when the case calls for it.
  3. Your riding history. Training courses, years of riding, a clean record.
  4. Jury selection. If the case goes to trial, asking potential jurors about their views on motorcycles.
Be careful online. Photos of wheelies or fast rides on social media will be used against you. Keep accounts private and don’t post about the crash.
